Degree: No Degree Secured: Coaching Class Ordered to Refund Fees | Ahmedabad News
Ahmedabad: The Gujarat State Consumer Dispute Redressal Commission has said that a complaint of deficiency in service is maintainable against private coaching classes and upheld a district commission’s order to one such coaching class to refund fees to a student for not helping him get the degree promised.
This case involves one Jigar Bhatt from Vadodara who paid Rs 1.03 lakh in fees for four semesters to Surat-based Institute of Management and Technology, which was supposed to ensure his admission to a recognized university and an MTech degree.
Bhatt was given admission to one Singhania University for two semesters. He cleared the exams for the first two semesters.
But the university was closed, and the institute secured Bhatt’s admission to C Motilal Jawaharlal University.
He appeared in examinations for the next two semesters and cleared the tests.
He was granted a provisional MTech degree certificate, but a final degree certificate was never delivered to the student.
The student sued the institute in 2015 with the Surat District Consumer Dispute Redressal Commission alleging deficiency in service.
The commission ordered refund of the fee amount along with Rs 4,000 towards compensation for mental harassment and expenditure incurred over the litigation.
The coaching institute challenged this order before the state commission, saying a consumer complaint cannot be raised against an educational institute.
However, the commission junked the argument and upheld the refund order.
